PARTICIPANT WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, INDEMNITY, AND MEDIA RIGHTS AGREEMENT

IMPORTANT: READ THIS AGREEMENT CAREFULLY BEFORE SIGNING. THIS IS A LEGAL DOCUMENT.

In consideration of Just Us Basketball, including its coaches, volunteers, staff, affiliates, partners, and any hosting or travel facilities (collectively, the “Program Organizers”), permitting my child or ward (the “Participant”) to participate in the Barkada basketball program—representing the Filipino American community in youth basketball—this includes, but is not limited to: practices, games, tournaments (local and travel), training, workouts, team travel, cultural events, media coverage, and all associated activities (collectively, the “Program”), I, the undersigned parent or legal guardian of the Participant, agree to the following terms:

JUST US BASKETBALL – BARKADA TEAM PARTICIPANT WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, INDEMNITY, AND MEDIA RIGHTS AGREEMENT (The “Agreement”) IMPORTANT: READ THIS AGREEMENT CAREFULLY BEFORE SIGNING. THIS IS A LEGAL DOCUMENT. In consideration of Just Us Basketball, including its coaches, volunteers, staff, affiliates, partners, and any hosting or travel facilities (collectively, the “Program Organizers”), permitting my child or ward (the “Participant”) to participate in the Barkada basketball program—representing the Filipino American community in youth basketball—this includes, but is not limited to: practices, games, tournaments (local and travel), training, workouts, team travel, cultural events, media coverage, and all associated activities (collectively, the “Program”), I, the undersigned parent or legal guardian of the Participant, agree to the following terms: 1. REPRESENTATION AND ACKNOWLEDGEMENT I affirm that: I am the lawful parent or legal guardian of the Participant. The Participant is physically and mentally fit to take part in the Program. The Participant will not participate under the influence of alcohol, illegal substances, or performance-enhancing drugs. I am solely responsible for determining the Participant’s readiness and capability to safely participate. I will ensure the Participant’s behavior supports a safe and respectful team environment. 2. NOTICE AND ACCEPTANCE OF RISK I acknowledge and understand that participation in youth basketball and team-related activities carries inherent risks, including but not limited to: Minor or serious physical injuries (e.g., sprains, fractures, concussions). Heat exhaustion, dehydration, or other illness. Exposure to contagious diseases, including COVID-19 or other communicable viruses. Accidents related to transportation, travel accommodations, or third-party facilities. I voluntarily accept and assume all risks, whether known or unknown, related to the Participant’s involvement in the Program. 3. CODE OF CONDUCT AND TEAM EXPECTATIONS I agree that: The Participant will comply with all Program rules, including the Just Us Basketball Code of Conduct. Respect and sportsmanship will be demonstrated toward teammates, coaches, officials, opponents, and spectators. Disruptive, dangerous, or disrespectful behavior from the Participant or family members may result in removal from the Program without refund. 4. ASSUMPTION OF COVID-19 RELATED RISK I understand and voluntarily accept the risk of COVID-19 exposure. I agree: Not to allow the Participant to attend any Program activities while ill or recently exposed. To comply with any local, facility, or Program-specific COVID-19 protocols, including masking or distancing guidelines if applicable. 5. RELEASE OF LIABILITY AND INDEMNITY To the fullest extent allowed by law, I, on behalf of myself and the Participant, hereby release, waive, and discharge Just Us Basketball, Barkada, and all Program Organizers from any liability, claims, demands, actions, or causes of action arising from the Participant’s involvement in the Program—whether caused by negligence or otherwise. I further agree to defend, indemnify, and hold harmless the Program Organizers from any claims, damages, or losses, including attorney’s fees, arising out of or related to the Participant’s actions or participation. 6. MEDICAL AUTHORIZATION In the event of illness or injury, I authorize the Program Organizers and any medical personnel to: Administer emergency medical treatment as deemed necessary. Transport the Participant to a hospital or urgent care center. I understand that: I am financially responsible for any medical services provided. The Program does not carry medical or accident insurance for participants. 7. INSURANCE & MEDICAL FITNESS I affirm that: The Participant has active health insurance. I have disclosed any medical conditions, allergies, or special needs to the Program. I am responsible for ensuring that the Participant is physically prepared for strenuous activity. 8. CONCUSSION AWARENESS I have reviewed and understand the CDC’s Concussion Information Sheet: https://www.cdc.gov/headsup/pdfs/youthsports/parent_athlete_info_sheet-a.pdf 9. FORCE MAJEURE I understand that scheduled events may be canceled, postponed, or altered due to weather, facility issues, public health mandates, or unforeseen circumstances. Refunds are not guaranteed under such events. 10. MEDIA & IMAGE RELEASE I grant Just Us Basketball, Barkada, and their authorized partners the right to: Record, use, and publish photos, video, and audio featuring the Participant. Use the Participant’s image, voice, name, and likeness for promotional, educational, and commercial purposes—including flyers, social media, livestreams, highlight reels, website materials, and advertisements. I waive any right to compensation for such use. 11. GOVERNING LAW & SEVERABILITY This Agreement shall be governed by the laws of the State of California. If any provision is deemed invalid or unenforceable, the remainder of this Agreement shall remain in full effect.
